[Discussion] Will cybercrime law affect our private server???

Hi guys,

Im here in Philippines, Our government will make a new law under the act of CYBER CRIME Law which include pornographic, cybersex, scamming online, spamming, and libel thru social network media.

Does anybody knows about this law?? I have my own server here and we are running the server for six months and i decided to closed temporarily the server because i know that weapons of war has a chance to report that there is a game that is pirate there server.

Is that true that I will go to jail if I will continue to operate my server? or is that true that I am using a hacked files???

I developed my server in my own knowledge I am just DL the server ver 207 and make a new things like buff textures but i make a set and buff that is same name to weapons of war just because my players wants that name and buff is that an act of piracy and hacking???

Really depends, sometimes they don't do because the amount of players that you take from they server for your server compare to they daily amount of players is like 10%... Even if you have 500+ online players daily, and for they shutdown your server they will need go to the court and sue you and this take time and money... So its hardly you see a private server close for this reasons! But doesn't mean it never happen already! Was this big Aion Server in china or japan I don't remember, he was the biggest private server around, the company who made Aion they went to the court to shutdown it and sue the owner and even the players who was playing on it! Other one is the first Silkroad Online Private server, the same thing happen he was the biggest private server round, got sue in more that 5millions of dollars! I don't know if all this storys is true but its always a risk when you make a private server and since is a new law specially for Philippines and they have they own server which they bought the copyrights, I don't think they will want to compete with other private server inside of they country.
And yeah you're using un-copyright files so it means its illegal and act of piracy to you use even if you make new items etc, and if you're using the same new even more, but if you're selling donate items that you made your own I don't think its illegal not sure about it.

But remember WOW is not the owner of the files so sometimes they can't sue you for it because they are a kind of private server them-self but with permission to be online.

Just to tell you something you didnt steal anything from Miracle Castle / FGN Games .. etc. you found the files in the internet its like when you download a pirate movie and someone can come and put you injail for it. They cant ... But you can get in much trouble cuz of P-servers and i will tell you why:
1. The money that you are making from this are illegal money: ( You are not paying any tax's on them no VAT ).
2. You can avoid that when you make your Private server a legal one you create a company and then no one can touch you for anything. And when you have a company and someone is steallling your files from your sеrver you can sue him.

I pay tax's and VAT since my paypal account is register as company, so everything that I sell I pay a % of it. But when is donate model is illegal money.

Rent a server of your neighbor country (The ping and connection still be good). Done, you don't have to worry about laws anymore.
I have never seen any private server get sue except the War of Warcraft.

MiraGame is not a company, how do I know? I've got deeper in their poop than you guy will ever dig (With all the respect to this sections' psilosophers).. After some wise words from somebody, I just got the "confirmation".

They don't have money, in fact it's really bad for them, it always was (Except last year.)
Their team is full of faggots, non-skilled people with lack of everything.
Their office is shate so are their PCs, they don't have money to afford anything.
They're just publishers, after all.

If there will be someone to be sueing, that'll be ShumenOL, doubt they'll sue an European/American server, they don't care.
After all, how much do you guys make per month? $500? Stop thinking like faggotry horses and realize nobody's gonna sue you for $500, especially when they don't have the economical/human resources to do so.

As most times Molder is right. I would not really worry about it. Unless you are making a killer amount from your server. Then I would worry. I am based in America. I thought about it and the laws are a little different here. Donations are donations. I use it to upgrade/maintain my server. As long as you can account for all the money from the server, you will be ok. Again though that's in America.
Here Donations are freely given and are tax free. Like a non-profit, you will not be taxed and most times no audits or anything of the sort.

If you are making a butt load of money and spending it on stupid stuff. Worry away...

Ok, thanks guys for the info about this stuff, BTW my VPS is host is other country i think that is in california much chiefer than PH I think I am exempted in this case/law because the server is running in other country so that the law will not apply on my server,,, is that right guys???
