Let me fresh your mind a bit.
1.
All private servers are illegal as the files were stolen. Downloading and using copyrighted material, that have been released without a working license is illegal. For me, 90% of what i do on the computer is illegal. Who cares? Nobody.
2.
Main reason. It doesn't affect them yet. In the future, when the private server community grows big it might affect them. And they might take action to the top servers, but they won't spend to much money on it. Suing is time, and time is money. At this moment, this community is small and therefore they simply don't care. The FlyFF section is a lot bigger, and I've only seen 1 sued server so far. It won't happen here in a long time.

You'll find releases and tutorials on the forum, that will help you creating your server. Opening the server to public, and earning money from it is illegal. So be aware.
