Also, shouldn't the name "Pokemonium" originally be credited to Tanomist? Maybe my information is incorrect, I apologize ahead of time if so.

By law, yes it has to be open source, but the open source that pokenet uses says that the only open soruce that has to be released is one where bugs are fixed, so pokemonium doesn't have to release it's client and server code until they have fixed things and when they think it is fine for public use.
