Judge Grudgingly Awards $3.6 Million In DRM Circumvention Case - Slashdot
Ridiculous Statutory Damages Rules Mean Judge Regretfully Awards $3.6 Million For Circumvention Of DRM | Techdirt
Technology & Marketing Law Blog: MapleStory Enforcement Action Leads to Ridiculously Large Anti-Circumvention Damages--Nexon v. Kumar

"The case involves an online game, MapleStory, and some people who set up an alternate server, UMaple, allowing users to play the game with the official game client, but without logging into the official MapleStory servers. In this case, the people behind UMaple apparently ignored the lawsuit, leading to a default judgment. Although annoyed with MapleStory (The Judge knocked down a request for $68,764.23 — in profits made by UMaple — down to just $398.98), the law states a minimum of $200 per infringement. Multiply that by 17,938 users of UMaple... and you get $3.6 million. In fact, it sounds like the court would very much like to decrease the amount, but notes that 'nevertheless, the court is powerless to deviate from the DMCA's statutory minimum.' Eric Goldman also has some further op-ed and information regarding the case and judgement."

Sounds as if the public media themselves are on our side. (and to an extent, the courts as well, they wanted to lower the cost in damages)

with that being said... are you going to post what you personally think about this or leave just post and drop like you're some kind of spambot?

Drop it like I'm a spambot. I don't have anything to say besides the obvious, the amount is way too high.

Why? You don't think you deserve to be charged for making money off of someone's stolen product?

    (below isn't directed at you)
I'm completely for private servers but when you run one and start accepting "donations" you accept the risk of this happening. Nothing to debate about here. If you're making enough money to support yourself + others through a private server then you're going to get this eventually.

Most people think they can put up a server and start collecting money with no risks. Its your own fault for being oblivious to laws that are easily looked up and researched. Be aware beforehand and you'll know how to avoid these situations.

But to the point where you owe a multimillion dollar company 3.6 million dollars? Isn't that a bit excessive? It's as if Nexon is making their money through suing others for their "easy to steal" work.

Sadly, it's their content and their game. You should've seen that this would happen by hosting a server sadly. :T

    -BankaiStory
    -PockyMS

All closed when Alex got sued from Nexon back in October or November(ah, good ol' days)

This is unfortunate for UMaple, and yes, 3.6million is quite a lot, and it does seem excessive for a game, but that's the world we live in.

3.6 million is a lot, but in this case, it's just UMaple being extremely stupid. Ignored the lawsuit? Come on, everyone knows what happened to that WoW person that ignored and now he ignores the lawsuit as well. If he didn't ignore the lawsuit, he'd probably get the same decision and offer as Rydah but nope he decides to just ignore.

Re: Default judgement of $3.6 million awarded to Nexon in the case against pserver

The fine I could accept since it's illegal to make the server.

The ridiculous amount that he has to pay I could accept since he took the risk and it's based upon U.S laws.

What I can't accept, however, is the fact that Nexon is only doing it for the money and not to stop people from circumventing their DRM:
MapleStory, of course, asked for the statutory maximum of $44,845,000
Shows you how much Nexon cares about "their" game and how much they care about "their" income.

3.6 million in total ? But yeah, their is no justice being brought through the court. As law stands firmly on the richer end. Which makes us and the community at the losing end.
