Legality of Private server

I wanted to open a private server FiestaOnline in Spain but I 'm worried about the legal issues .
I know that all private servers are illegal , but I have some doubts.

What is the way to do it at least possible illegal ?

I want to put donations but only to keep the server only? Should I declare the benefits ?


Do any of you have a private server ? What do you advise me?

Is it likely that gamigo / Outspark take legal action against me?¿ IGNIS ? is a legal server?

Taking any type of money donations will result in Gamigo DMCA-ing your paypal account or your hosting company.

Ignis is legal because we use an emulator, not actual server files from OnsOnSoft
