I was just wondering if any of you had a clue about the legal aspects of having a PW private server.
Can PWE or PW China sue us for redistributing their game and sell whatever currency to buy items from cash shop ? (like cubi, etc..)

They can... Granted the server itself, not the person that owns it, is in a country where PWE/Wanmei conducts business.
If you host it somewhere Wanmei/PWE do not conduct business OR a country that typically isn't very friendly to international civil disputes (e.g. Russia) they can't do anything.

So, for exemple my server is in Germany but I'm in Mexico. They can shut my server but they can't do anything to me as the owner, right ?
Yes, they can contact the hosting company and have your server shut down but, technically, they can't do anything to you UNLESS PWE somehow manages to convince the US government that you deserve criminal charges in which case you'd be extradited but the chances of that are slim to none... (The most any company can bring against someone is a civil suit (which will never happen as you'll get laughed out by the clerk of court for trying to bring up an international civil suit), corporations can not charge you as a criminal as much as some people (the tards that saying violating a TOS is "illegal") and companies want to be able to.)
Overall you don't really have much to worry about, PWE/Wanmei haven't really ever gone against private servers that often and the few that they have were just asking for it by spamming the PWI-Forums or something like that.
If you create a PW Private server you can be sentenced to hang in public square.

I think they can send you to be hung if you use one of those dumb 'legal disclaimers' -- you know, the ones that say "if you work for or are otherwise affiliated with PW PWE PW Beijing" BLAH BLAH BLAH "you are not allwoed to enter this site" etc...

I've ranted on this part of the subject before... They really do offer you NO legal protection for shit... (I have talked to an attorney about this, though I myself am not one)
Look at it this way (I know totally different subject but, whatever)
Lets say you (live in NY for starters LOL) stole a New York city cop car. Then you put it in your driveway. To help prevent people from 'seeing' it you construct a huge sign that says "new york officials - KEEP OUT - NO TRESSPASSING -" -- is that going to change the fact that you're indeed in possession of a stolen NYC squad car, NO...
same idea, here (at least kinda) even though they're not entirely alike... we 'possess' uhm certain 'files' that, you think if they REALLY wanted you, some stupid little 'agreement' is going to stop them and their top notch lawyers, NO...
I could see it (if it ever came to it, like I said if they {the company [pw]} "wanted you bad enough"), I could see it now in court:
JUDGE: "you're being charged with blah blah blah etc etc etc"
YOU: "but they violated MY agreement"
JUDGE: *starts laughing*
JUDGE: "you mean to tell me, your only defense is accusing the plaintiff of removing the very blanket you put over the property you stole from them, after you told them not to..."
JUDGE: *continues laughing*
... 2 seconds passes
JUDGE: "GUILTY"
JUDGE: *slams gavel on desk*

But no... in all seriousness I think there are a few things 'protecting' us
and it sure as hell aint those dumb 'notices' some people put up... (and this has all been discussed before):
Like for 1, the server/client we have is so old; they probably really don't care any more. Not like we're too much of a threat to business (at least in their eyes) when we are SO out-dated.
Hosting in 'other places' like Das brought up always helps too :)
Now I don't know and am not sure or confident to say what places are safe to avoid possible civil and or criminal liabilities for hosting a server, but I'm sure they exist... But MOST importantly (to me anyway) is: I am pretty sure you'd receive 'cease and desist' orders and be given the chance to 'cease' running your server before you'd find yourself in criminal or civil 'trouble' :)

BTW - 343 I wanted to ask you, do you own a server? A server to the public? I was viewing xtremetop100 for the hell of it, and noticed there is quite a bit of people mentioning your release. Go look through them. Do you actually own/develop for a server though?

Do I own a server? Technically, I own MANY servers. Physical machines that is... I own, oh I'd have to say, about 15 servers at the moment. The only server(s) currently 'for the public' though is my web server(s) (no I don't have a 'live' PW server currently). Sorry, not trying to be a smart assjust trying to answer in a literal sense... I think I'll go check out that 'xtremetop100' in a little (never have before) and although there is at least one person from here that I know runs my 'release', I don't explicitly or implicitly develop for any one person or server at the moment, my own or otherwise... I do what I do, for the "community" 'as a whole'

Well I have 15 servers yes, but only about 4 are 'set aside' for PW (and none are 'public' {yet})...
