My server is being investigated right now so it is shut down I could lose everything anyways so...
it was on the PWI actual forums where this was discussed.

#1 I am very sorry to hear the news
#2 I would like to remain informed as someone who is genuinely concerned about his well-being; as a person
#3 In the event of something like this you ALWAYS take a backup of whatever you have and store it on an external drive at an external source(location) if at all possible. This way it can always be restored in the future, even if by a different person/entity.

Not really. I mean; they could try to, but they even must know there is no way they could 'get' everyone running a private server. This was even apparent to me when I was poking around the official forums after hearing this news, and saw and I roughly quote (paraphrase) from a PWi official GM "We know we cannot stop them all, but we can stop some"!!!

not really, I do still think NOFX is right as far as if we did have newer server files or emulator that could work with newest 'official' client 1.4.2 they would certainly come down harder as that would be and is a threat to their business. Maybe this investigation will just be to attempt to determine if he had 1.4.2 or was using the old 1.2.6 :? (lets hope)

This is exactly the case. The official company is most likely to go after the most well known, and most populated private servers. As first off this is easiest for them to find, because anyone can type "google perfect world private server". So if your server comes up in there I would think you could be screwed because anyone working for official don't have to work hard at all to find you. Also the ones that are most populated are the biggest potential threat to their business (and loss of revenue). So basically put;

emulator is legal copyright i thing.. because its not files from offical. we only use offical client like aion, but we cannot modified client side if not want get shut down.

well I am not a lawyer (but I play one on TV), but even emulators often push their legal boundaries and are often ruled ILLEGAL in a court of law.
Take for example AION, first off the company does not offer a download of the AION client for free. So even having the client without paying for it is a © infringement.
Now, moving right along to PW. You say 'well the PW client is free to download for ANYONE' right... well for the most part you would be right in that statement and thought process, although of course they still 'own' their client. So if you do 'misuse' THEIR client in any violation of THEIR "TOS" the court would find that you infringed their © (or at a minimal their contract). I do happen to know that it IS in official PW TOS that states you cannot use their client with any emulators too...
I know private servers are a ton of fun to make and mod (can't say if they're fun to play on or not because i've never played on one), and I know we can try to think of ways to skirt the legalities involved (or lack thereof). However you have to remember that no matter what we think of; these companies have millions and billions of dollars and top notch lawyers that could still nail us to the wall if/when caught.
So I think the trick is not to find out how to skirt law and courts, litigation, and hardware confiscation. But I think the trick is how best to stay underground ; and not GET caught!

...and this is exactly what I mean by these companies have millions and billions of dollars and top notch lawyers. Even if they didn't have that in there I can still guarantee that they could still find a way to nail you to a wall when you're caught running a server/server emulator or anything of the like that could possibly take business away from them. (and trust me, there's a LOT of fine print from any companies legal department)

This is why I re-iterate :

as far as actual running private server advertisement... yes I think so. I wouldn't want my private server on any "top" list because then that will make it that much easier for the 'official' company to find me :\ at the same time we know having an underpopulated server will be no good for your players... it's a damn catch 22

I was shutdown by an external source, someone has been reporting to my host for some time now saying I am hosting Illegal and copyright material, I got an email this morning advising that theyre shutting me down for investigation, i just got one back about an hour ago advising my access is removed and I am not longer serviced by them. I did backup daily and I also did have a repository where I kept my backups but tht had a HD failure about a week ago and I am still waiting for them to fix it, its like pure unluck for me right now since I only have my test server with the upto date config folder.
