This is just a weapon model issue.
Simple fix in 3ds max
You just need sandurrs smd reader + ase plugin tool + 3ds max 2012

Convert smd to ase, open ase in in 3ds max, click the model, change pivot, then rotate the spear 180 degrese.
Might need to also rotate the pivot down a bit too, so the spear is held properly in the hands, not hovering above the left hand like is the problem with most spears.
Quick video on changing pivot on knights sword so it does not sink under the cape, same method, just experiment with the pivot to get it positioned correctly in game
