So if the packet/opcode is incorrect I should get an error 38 right?

What do you mean go through the login? you mean login_password?
You only get Error 38 if your packet length is too short or too long. If it matches the structure but the opcode hasn't been updated or doesn't exist, etc, it won't give an error 38 code.
When I connect to a server I do not get past the login.
