Got a note from NC Soft about my Legal L2J server

Hey guys I am the owner of one L2 Private server.. www.l2anarchy.com

Its L2J so i thought that there was no problem

thats what my partner received..

are they allowed to do this?

I received this email at approximately 7:30AM this morning.

NCSOFT, Inc. is a corporation (”NCSOFT”) that operates an online community under the federally registered trademark NCSOFT.

It has come to our attention that you are operating websites under the domain names www.L2anarchy.com. We are writing to demand an immediate halt to certain ongoing illegal activity.

Your activities violate various federal and state laws, including without limitation trademark and trade dress infringement and false designation of origin under the Lanham Act, 15 U.S.C.

I think they are just trying to scare you as L2J is legal.

Dont know what the fuck.. i will wait for further announcements..

i think that L2J is 100% Legal L2 Emulator..

So Rename the server .

Even If they Change there Eula You can always Use an Old C4 Client that was Destributed without the Licence changes and Run Ur l2j server in c4 or an older "leagaL" client .

Yeah rename it so that L2 or anything based on Lineage II is in the name and you should be fine. Also make it clear that it is using L2J.

hey kost do you have an custom system folder? cuz that is not legal... i think that's waht they are talking about... or they are talking about donation... dunno lol

Say that You developed a Server Software "Simulation" and that it is neather Emulation nor Pirated Official Files. And that all software server side is not from Illegal origins.
Also avoid Using the Name/Trademark/title on web pages. And call the server something anonymous like . . . Heavens gate Rpg . or some thing. .

people have done this with a Game called everquest ... seems to work for them .

Id like to see the email headers to see if this realy came from NCSOFT, there is a few "LEGAL" holes in there email. and by no right, will i transfer my domain name that i registered to them, if they want it, they can buy it after i put it for sell for say $1millon USD as they put it. You can host a 100% legal l2j server since u don't offer any client mod you must connect changing your hosts file to be legal, besides to the "donations" u accept must be used only to pay server bills and not for your own good...

Bullshit.
I was running the OpenWoW EMU stuff and got charged by Blizzard (the Netherlands).
They lost the case since EMU's are in the Netherlands allowed.
L2J is completely legal as long as you don't mess around with the client.
If you do, then your in violation, but since you can change the HOSTS file, there is no violation.
Ofcourse, L2Extreme is a good example for being using bad software.
They used stolen software from NCsoft from which they can counter attack ^^.
The ToS is just a "this is what we want you to do", and not a legal right.
All at all, it depends ofcourse where you are have the server located, since Germany would be the best choice for hosting it ^^

See Told You guys it all Depends on ALLOT more variables than just running the server . . .

If you don't want your server to be shut down . . . just host it out of the USA and you have nothing to worry about . . .

L2j its self is not illegal ( as said like 1000's times)
Moding Nc soft Software is Illegal (client)

The Eula is for users ( Not website / server dev's) its the Users that Violate the law. . . by using Ncsoft software to connect.

Now the only things Admins have to avoid is:
1) Do NOT link to client files/installers.
2) Do NOT host ANY modifications intended for the client.
3) Do NOT use Ncsoft Trademarks / Names like L2/Lineage2
4) Do NOT Collect Donations / Do NOT sell Items.
5) Do NOT Tell People how to Mod there clients.
6) (I guess You can Upload a host file and let Users Figure it out alone.)
7) Make sure that You make it Clear that You are not using any Nc soft Software on your end.
8) I think if you follow these guidelines you should in most cases be fine. . .
9) For added safety just host out of the country or behind a Dynamic Ip Address and use Redirection and or No-Ip with false Info upon Registration.

The moment you mention Dynamic Ip (changing Ip Address) In court you can completely deny even hosting the server ^_^.

I say again, i think its fake, because i dont think NCSoft write wrong ....

1) Why not Bring Down Hopzone / top 200 /top 100 sites.
2) Why not go after the Developers of l2j if its so illegal.
3) Why not come after Forums like this ?

If i was Ncsoft I would go after the major spreader of l2j / off.

Lanham Act, and Trademark Dilution Act is not what they are using to go after the L2OFF sites. What they are basically saying it the term l2Anarchy is their trademark, which a lie. The letter is also not from the FBI, it's from NC and a highly doubt the can fine you.

This has nothing to do with your game server, it's all about your website.

Write them back and ask what parts of your website they consider their trademark and also contact a lawyer.

Isn't any Private Server, Emulation, Emulation of Original game illegal. Since your almost like stealing the game from the original owner and company of the game. Emulating a game is just producing a copy of the game owned by its company. Then companies sell games totally to other companies. If you didn't buy the game/rights of ownership toward the game you may be sued for taking the game without authorized permission and stealing the game for your own use. A game belongs to a company unless sold to another.

L2Extreme died? When? Dang what happened to the owner? I used to play there.

Mostly games that make its player pay to play have the strength to sue the private servers, and mostly those games are the ones made into private servers.

It isn't for the U.S.A
But if your not in the US hosting the server its harder for them to get you since they would have to go through countries and if the country isn't very happy with each other the government isn't going to bother each other risking a start of a war. I mean I'm going crazy but it'll be harder to track down.

But don't be surprised when you see 2 guy in sunglasses and suit staring at you in the sidewalk.

One last thing. Ragezone got protection? The many companies of all these games if they decide to close down private servers they can get RageZone down but seeing Ragezone it'll be hard for them.

You can actually get away from any trouble in court. Your problem is the use of L2, Hosting a Server for a game you gain no ownership to. Plus modifying their game.

Change any L2, Lineage 2 or anything like that, that have to do with Game servers. Use a hidden or Dynamic IP. They can never get to you, since your Internet Provider and you should have an privacy agreement and Dynamic programs may not review your IP.

But then again I suggest you hide down for a while.

If Blizzard came with 2 lawyers and a programmer of WoW at my doorsteps, handed me over some papers I should sign.
Never did this and allmost got them suid for harrassing me for nothing and never heared of them anymore (I love Dutch laws isome times :D).

EMU Aren't allowed anywhere but like I say depending on what game you are emulating and making a private server out of and where their company are mostly at, then going to another country and saying that they broke the law it would be much more complicated. Certain countries have laws and rights to protect their citizens from others. Thats the specialty that you get being in certain countries.

Being at the top of hopzone doesn't mean its a good server. NOT AT ALL.
Plus... have you ever counted how many times you place everywhere: SUPPORT US! DONATE TO US! WE WANNA GET RICH!! That's just stupid and ILEGAL! That's the main reason why they sent you the mail.

Ok Tank... you need to re-read the GPL that in which L2J Runs under.

L2J Is a free OPEN SOURCE CODE server for any one to use freely, only time you can be done is using a L2J software and then charging people to use the service, that is where the law comes into action.

People L2J is free LEGAL software because it is a OPEN SOURCE Project.

Just change the name and it should be fine. Or u can host the server in Canada ( its where i live ) where the FBI has no legal rights and we r just on the boarder line with America :D

How good that this crappy Digital Millenium Copyright Act can't be applied inside the EU :P It's an US law.

Also there are no software patents inside the EU. (at least not at the moment) So reverse engineering a protocol and writing a server for it (with own code) is legal.

I remeber seeing 1 of the first NCsoft cease and disist orders sent. It was back during c1 being hacked. HSC was served a cease adn disist order, very similar to the real one that was posted for l2community. HSC however foudn a loophole and ignored NCsoft, and HSC was never punsihed. *checks HSC site now, its down, hides in cornor* It seems NCsoft is pulling out all teh guns against L2 C4 OFF servers, but this L2j one is a fake...

L2J Is a free OPEN SOURCE CODE server for any one to use freely, only time you can be done is using a L2J software and then charging people to use the service, that is where the law comes into action.

Who gives a shit if the project is legal? Hosting a server is providing an unauthorized service, which is illegal, end of story. I really dont care about being banned, the hosting of an l2 server is dead now. Now that C4off servers are almost all gone, l2j cant replace it. Its too buggy and no one wants to waste their time on a low rate l2j server. They either went back to official or moved to a different game.

Might i remind you forign country L2 OFF servers are safe?

L2j is 100% but client modification or edit any file of L2 is Illegal, you can run your server with l2j but you cant edit the Client.

yes, u can use L2j for free, but there was only 2 rules, you cant earn money using donation.
and there was another rule yiou cant use L2 Client, only L2Walker, but who knows what kind of software ppl using to connect to ur server...
donation on L2j can be offence, but nothink else...
