The 18yo above was caught writing her name on a cafe wall and she received 3 months jail term... what the fuck, pretty harsh considering it's her first time offence, you look at drink drivers, most of them who have been caught 5, 6, 7+ times never have to face a jail term sentence, I think it's complete utter bullshit - this may well ruin her life, instead of giving her an educated punishment they just lock her up - and now she has a criminal record to do deal with.. good luck to her getting a job, financing and so on.

A three-month jail term handed to an 18-year-old woman who wrote graffiti on a Sydney cafe's wall is "absolutely appropriate", NSW Premier Nathan Rees says.
Cheyene Back, from Daceyville, faced the Downing Centre Local Court on Monday charged with intentionally or recklessly damaging a brick wall, the property of Hyde Park Cafe, on January 11.
Magistrate Ian McRae jailed her for three months, but another magistrate later granted her unconditional bail pending her appeal, listed for March 4.
Mr Rees said he thought the three-month sentence was right.
"Everywhere I go graffiti is an issue," he told reporters. "This sends a message that it's not something that the community regards as a frivolous offence.
"It is something that affects not only the aesthetic but people's sense of safety.
"They see graffiti around and they think there is other anti-social behaviour going on and I think a three-month jail term is absolutely appropriate."
Cafe manager: she should be made to clean up
But the manager of the cafe said the three-month prison term was too harsh.
Hyde Park Cafe manager Song Wang said the girl should be forced to wash off graffiti from walls all over the city instead of going to jail.
"You know it was really frustrating when she did it, but the whole group did it, not just her," Mrs Wang said.
"I think it's a little bit harsh [and] I really prefer the Government doing something more ... some more video cameras and give her the education about it instead of jail.
"Maybe she can do some community work or something, such as letting her clean all the graffiti off, let her know how hard the work is she makes."
Mr McRae sentenced Back, who had no prior convictions, to three months' jail for intentionally or recklessly destroying or damaging property.
The cafe owners were seeking $200 in compensation.
According to documents tendered to the court, Back was with friends at the Hyde Park Cafe on Macquarie Street, just before midnight on January 11.
One of people she was with, Robert Napoli, was caught on closed-circuit television drawing a message on the wall.
Napoli then allegedly handed the pen to Back, and the footage caught her writing a message on the wall.
Mrs Wang said the group were serial pests who had cost the cafe $200 a week in clean-up bills.
"This group did came to my cafe every week around Wednesday or Thursday, once a week," she said.
"One day the girl made [graffiti] just inside the toilet and all over the walls and smashed my mirror. They even got on the roof. I don't know how they did that, it was all over.
"But I still prefer the Government doing some more education for her because she's only 18."

This is something we see happen everyday and those people usually get a ticket. Going to jail for 3 months is very severe, most of the people who do it is Under 18 so i think this person knows better
EDIT: Graffiti is art to me because it expresses many meanings through colors and font.

Three months is a bit too severe. I'd honestly give her community service and have her pay for damages, but by 18 you'd think she'd know better than to do something like that.

That was not harsh at all. Graffiti in Australia is a HUGE problem and costs us the tax payers billions of dollars every year to have them removed, or in some cases, to have the property replaced if the graffiti is that bad.
I say use her as an example and have every state adopt the same attitude. It is absolutely abysmal riding the public transport and seeing every single window graffiti'd and having the fare for the public transport increase annually because they have to pay more to have them removed. Every window also has a sticker placed there by the government and they say something along the lines of "This is the reason why your ticket for this bus has increased by 10 cents. If you see someone damaging public transport, report it.".

I agree but they could of made an example out of hundreds of people who take up whole walls, with block letters, and 10 different types of colours in it - like below;
I agree with you to an extent but what about all those drink drivers who get off a jail term, criminal conviction etc and they end up taking a life or lives.. I just think it's bullshit how they ruin one girls life for a being an idiot but when they catch a drink driver 5, 6, 7+ times, and still nothing happens.

I don't get why you guys are making such a big deal over this? If she hadn't vandalized someones proprty, she wouldn't be going to jail. Plus that's what's wrong with the world today, to many warnings, so people just keep doing it with out any worry.

Ahh, but she didn't write on the side of a building - she wrote on the side of a cafe's wall. So the difference is that she caused damage to PRIVATE property instead of PUBLIC property. Keep in mind that there is a difference between being drunk and having slow reaction times, and being a vandal who destroys property for no reason at all and you have 100% control over what you are doing. Also remember that there is a small percentage of people who do not drink and only get drunk cos people spike their drink... it may not be alot of alcohol but someone who does not drink will be quite sensitive to alcohol which would result in dangerous drink driving without them even knowing. Nobody can force you to write on a wall.

They didn't have to go to the extent of jail though, she's 18, why couldn't the judge give a better punishment, like reintegrative shaming, jails don't work, it's a proven fact, in Australia the correctional system can't get the recidivism rate down past 60%, it's obviously not working, there focusing on punishment way too much, but instead there's other ways to deal with this girl, like reintegrative shaming, she could of been made to sweep the sidewalks along Hyde Park Cafe or wash the tables/bins/walls/windows and so on, but no the judge decided to throw her in jail for the three months.

What? so you're saying that it's alright to cause injury/death to the public if you're under the influence? but if you were sober it would be manslaughter? that's what I see you saying? (probably not what you mean :laugh:)
If you're old enough to drink AND have a license then it should automatically be 3 months DQ from driving, period - no matter how experienced the person is at driving.

I agree. Writing your name on a brick wall, while easily washed out, ruins society. We should crack down on everyone who writes on bricks. Why, do you know how much damage a marker does to a brick!? It is tremendous. More than a drunk driver running through a mailbox.[/sarcasm]

You all are looking at the case wrong, because the person who wrote the news post made it seem like a completely different story.
She didn't go to jail for writing her name on a wall, which is what the idiot who wrote this news post is trying to put out there. She went to jail for vandalizing private property, which is indeed a jail-able offense.

If someone came inside your house, spray painted their name on your wall, and left, what would you do to the person? She vandalized private property. She wrote her name on the wall. Obviously she's not very smart and deserved a taste of reality.

There's a difference between outside on a wall at a cafe with a texta and breaking into someones house and spray painting their wall and she wrote her NICKNAME (2shie) not her real name.. read it ffs.
