Okay, so as I was reading here:
Let’s Talk About Retros | Behind the Pixels
I found out about sulakes interpretation of habbo retros...
It's pure bull-sh!t.
Just reading this makes me mad, makes me want to start some sort of development for habbo retros.
anyways, I posted this thread because, of this....
"If you created a game with no data, no graphics, nothing that was trademarked to Habbo at all.. then it wouldn’t be Habbo, so.. I guess it would be legal? Why not go ahead and create your own game? :)"
Apparently they don't know what trademarking is.... they only have these trademarks "habbo, sulake ect ect, under there name... so that means, if you change everything from "Habbo" to your hotel name, everything is golden... but that will take a lot of work...

First of all this is just Propaganda to begin with, never once have I ever received a virus from a retro. That is literally an unintelligent thing to say because anyone that knows anything about a computer knows you cant receive a virus by entering a website. Secondly how can "stealing" something intangable be illegal. Obliviously you guys have never heard of the "Fair Use" law in the United States where it is 100% legal to run a habbo retro if infact no money if being made by offering VIP. Maybe you guys are just feeling loss of profit because you cant keep up with your own hotel. Offering membership where you pay one rate a month and can build however you please instead of paying 20 dollars for 50 coins you cant do anything with.
I have no clue, anyways to make a legal habbo retro ? maybe the fair use?

Create a hobby hotel under the fair use act of 1976. Use it as a educational site to develop how mmorpg work and how to interact with your users. Dont make profit and change all trademarks and you fine. Different laws apply to different areas so if you want buy a vps in Sweden nothing to worry about just stay anonymous and sulake cant do shit.

Well there were some dickheads in this community that did some java drive bys.
But 99% of the retros wont give your virusses.
Sulake has copyright on some of their 'codes'

Sulake doesn't understand that there actually are a lot of retro owners who care for each and every user they have. They don't understand either that most of those retro owner kiddies are 12 years old and don't know anything about viruses and trojans. Retro users mostly play Habbo and Habbo users mostly do not play retro's. They lose their fucking users because the Habbo addicts are getting older and Habbo is getting uglier every update.

Theoretical yes. As a CMS developer doesn't use any codes made by sulake. However providing a full web-gallery used with the CMS can be a problem.

Uhm isn't it the same thing?? People that uses habbos template uses Habbos HTML/CSS/JS code and images. People that uses other custom templates often also contain a little bit of Habbos code with alot of custom things tho. All retros got to be using their graphic aswell.
But the server code is not theirs :)

I know, but they make it out, like we want there habbo passwords and we give out viruses...
Actually its more the other way around....
I have done some hard work on my retro... and they make it out like were bad, and we never do anything, never made a custom swf and stuff.. (We riped most of them) But its said when habbo staff gets paid tons of money for making a "furni swf"....
We do it for free....

So their client files are not theirs? There their software and we use them illegally, stop denying that we are criminals, we are. They have every right to come after those who run a hotel because they illegally emulate THEIR copyrighted software.
And fair use policy doesn't make it okay to be a criminal, Oh hey we use piratebay for fair use so we're exempt from any law suit.

Habbo retros are illegal. If you recive a dmca or other legal document you should stop what you're doing right away. Whoever if you chose not too your an idiot and pretty fucked when they come for you.
It's an easy conclusion. Now can we get an end on these endless topics about dmca's and sulake taking action. We get the point.

you guys wish there was a way to bypass sulake and make a habbo retro but in reality there isn't.. use it as educational site? yeah right you would need sulakes permission to use their images.
if they have their own created images from scratch and trademark them, it is them who only have the license to use them.
there is no possible way to create a 'legal' habbo retro without sulake letting you.

The retro sites operate using a server emulator. Some people, who are specialized in developing server emulators, make their living by selling them.
I just remembered Yifan Lu and Meth0d asking for donations to order pizza.

Wrong. There is a way. If anyone knows of Jabbo, one of the older Jabbo versions is pretty much 100% legal. Doesn't run on an emulator, doesn't use flash, so no using Sulake's SWFs, the only thing you're using is their images. But hey, fansites use their images and they aren't getting any DMCA claims. So that pretty much means if you run Jabbo you're safe. But just to be safe, change all their images to your own (just design all your stuff in Photoshop).

When you are a official fansite, you have all rights to use their IPS. So they never will receive a dmca..

To be honest, there's no way to "bypass Sulake" because you're using their images, codes, etc. It's copyrighted, so therefore they have that right to sue you for copyright infringement.

Yes I think so, but it seems like people prefers to use comfortable software (made by other people of course) taking risks instead of learn and make something new and different, they don't really know that Jabbo is one of the best releases of the section and they prefer to discuss about this things that doesn't bring nothing new to the community.

Yeah, people always say that the spanish retro community are dumb, i'm there watching it all the time and i'm totally agree, but some people are intelligent and creative, just only see that 3 games created by my friends.

That's a very nice idea :) and I think it's pretty safe since youtube usually has good precautions against pornography.

Retro's will never be legal
Retro's will never be legal cuz the fact we're using their assets without permissions of Sulake. Jabbo isn't a legal alternative either, it's using their images.
Fansite's are legal under a terms of agreement, they have permissions of Sulake to use their images.
The only way to create a legal MMOCC, create your own game.

Well, Jabbo was great about a year ago, same with KekoCity (I don't know the others). But for modern computers they are written quite bad, because they use div's etc, whilst nowadays it'd be much more efficient to use HTML5 and canvas as they are sometimes even hardware accerlated and thus can react much faster than using dom injection.

You can't legally stamp a copyright or trademark on 'code', if it means be HTML, CSS or even Flash. But they can protect their trademark, and their artwork/graphics. Emulating something isn't illegal itself, because it's not bypassing or obstructing their actual services which is their actual hotel (habbo.com) - With thus being said, a emulator or CMS developer can't be breaking any laws unless they are using either their trademark name to help promote such software or interlectual copyright, which is their graphics and SWFs. There's not much you can do to protect your interlectual property, because one can come up with the same ideas as another. It's like saying someone can put a copyright on a black pixel, but at the same time, other people are going to use the black pixel for their own work.
There honestly shouldn't be a fight between retro owners and Sulake, there should be no 'war'.. Sulake isn't loosing anything because of retros, if anything, they're gaining from retros. They're gaining from retros, they're gaining their knowledge in protecting their property, they're learning how to secure their product. Without retros, they wouldn't know how to secure their work, without retros, if they did update to something big, they wouldn't be adding as much SWF security to it. It would all be wide opened just like it was back in the day.
