According to these legal Blizzard is suing Valve to prevent it from trademarking DOTA name. Blizzard claims that the DOTA name has been aligned with the Warcraft series for the past seven years. Defence of the Ancients was originally created for Warcraft III as a mod.

“Valve seeks to appropriate the more than seven years of goodwill that Blizzard has developed in the mark DOTA and in its Warcraft III computer game,” claims the suit, “and take for itself a name that has come to signify the product of years of time and energy expended by Blizzard and by fans of Warcraft III.

“Valve has no right to the registration it seeks. If such registration is issued, it not only will damage Blizzard, but also the legions of Blizzard fans that have worked for years with Blizzard and its products, including by causing consumers to falsely believe that Valve’s products are affiliated, sponsored or endorsed by Blizzard and are related or connected to Warcraft III.”

Here is a video which explains it very in-depth:

I wish that Valve wins the court so we can get out DotA 2, but Blizzard got some very strong arguments. As said in the video, it can turn out very nasty :(.

Also for those who still dosen't understand the situation, is an article, made by our very own News Editor Chewbecca, explaining the situation.

Already posted how I feel towards this in another forum, copy/paste:

Me! said:
Dota was a custom map, other than being made within WC3, that had no association with Blizzard otherwise. And the fact that the creator of said map is working for Valve now to carry on and build onto it's concept, the map name belongs to that creator, not Blizzard. It's pretty much the same thing that happened with Team Fortress, a Quake2/HL1 mod turned stand alone for it's sequel, and Counter-Strike.

Therefore I'm with Valve on this one, and Blizzard have no right say otherwise.

I don't believe for one moment that because the map was 'posted' onto b.net, that it automatically makes it Blizzard's in everything related to it. That'd be like someone publishing a story onto one, of numerous sites, fanwork, or w/e... and that site suddenly owns the rights to that story.

What of those numerous maps of questionable, porn, bigoted, e.g., content released in WC3 or SC1 back in the day? Are you going to tell me those are products of Blizzard too? That they'd be eligible to be sued over such discriminating content for hosting them...?

I thought not...

Blizzard can go duck themselves, they've proved time and time again for the past 5 years that they ruin anything they touch. What exactly has Blizzard done for DOTA though? Just sounds like they're annoyed for not making money of DOTA sooner.

Tbh even if Valve does win and gets the TM, I honestly can't see them suddenly being dickheads. Blizzard on the other hand...

PS - I know Blizzard aren't after the TM but they just want to cash in off the DOTA name that the fans created.

They're going to make a crappy Blizzard DotA copy, and by then they probably already killed it.

I agree with this, Blizzard has not tried to trademark the name, merely they are trying to stop Valve trademarking it. Their argument is valid, DoTA is symbolic of WarCraft III and Blizzard, if Valve got the trademark they would in turn stop Blizzard having any use of the name.

Why should Valve be able to trademark it and have it for their own when Blizzard who have a much stronger claim in law haven't done so and allowed the DoTA name to be used as it was intended, for the community.

I've got to go with Blizzard on this one. I find it strange not associating Dota with Blizzard but rather with Valve. Blizzard does have a right to the name, considering all of the marketing and value that has gone into it.

DOTA is currently a registered trademark of Valve.

Blizzard is only now appealing the decision (they aren't trying to prevent it form happening, it already HAS happened, they are now appealing it) because they just recently acquired ownership of the original DOTA-Allstars website late last year (Guinsoo > Riot games > Blizzard) and are using that to build their case.

I knew this was going to happen because blizzard is going to lose alot of money since no one will be buying war3 anymore to play dota. The name Dota was not made by blizzard neither or the skills all was made by icefrog.

Go suck penis blizzard!! War3 that i am playing dota on is pirate so no money for you hehe!!

Blizzard needs to duck off. lol

DoTA is the only reason anyone even play wc3 anymore. They don't have ownership over that poop anyway. DoTA was a custom player-made map. If anything, the guy who originally made DoTA should be the one suing Valve, not blizzard. lol

Thats bs. DoTA-Allstars != DoTA anyway.

lol, that may not be the case, but it is still totally true. I bought wc3 to play some of my old favorite custom maps online again but all there is are players hosting low-player DoTA games and bots hosting everything else because no one plays them.

Some of the biggest DOTA communities are private PVPGN servers which don't require battle.net authentication; I've been playing DOTA for over 7 years on a pirated copy of WC3 which I've used on Over 30+ machines.

that is true as well. wc3 isn't even worth buying anymore and if I could've gotten a refund because of how dead the servers were I would've lol. Really only bought a legit key to play online with a friend who knows nothing about private servers, otherwise I would've played them on eurobattle.net.

This whole case is stupid. They should've sued over this a long time ago, not right now. I think its just a stunt to slow down the release of DoTA2.
