What to do when JCE Entertainment comes?

What do we do when JCE Entertainment comes to the forums? Because this server is totally illegal ...

If it were emulated we'd still have to make sure that Diosa received payment from players playing on our servers because we live in the U.S. and are using their our emulated server as a means of service, according to the DMCA. Their way to make sure their software is in use and up-to-date is to issue KEYS with current players and we'd also have to issue those to be sure that the use of our service with their client is valid created by JCE are valid.

Now, if both the server and the client were emulated (way too much fucking work) this would be totally legal.

Now, since this is "hacked/stolen" the service being used is totally illegal because it is not of our own creation and is copyrighted by JCE. There is no way to use this properly w/o breaking the law.

Just wondering what you guys think.

I agree with you on this that this is illegal. Infact, JCE has the right to sue and to shutdown the entire RaGEZONE forums. This is very unlikely to happen but it could if someone posted about ragezone in a different forum that possibly has employers of JCE. We and when i say we I mean the people that did not set it and are not mods or anything higher would get sued for owning the server files. All that would happen to us would probably just be asked to sign something saying we cannot use,download, or play any JCE entertainment games and we would be asked to delete the server files and clients. And if RaGEZONE did get sued, it would probably happen multiple times more because not only do we have server files for RedMoon but server files for many more games. This is just my 2 cents

I really dont think they could do much seeing as we are just using thier **** to give people the services that they couldn't. If they did do something it would be in spite of jealousy lmao.I dont really know much about the legal actions that could be taken But I dont see any harm as long as we dont make a profit off of the game.

now if you were MAKING MONEY off the priv servers, thats another story, expect to be sued.

Keep in mind though .. since these are international violations it can escalate to a higher forum for them to have this stopped ... under the guise of political relationships ... additionally if JCE is a powerful entity in their country ... and the ever advancement of intellectual and proprietary information on the internet .. the courts will not care about anything that individuals whom feel justified to do this on their own, as a claim of justified infringement! Courts usually deal with one issue at a time .. if this is international infringement .. it could give a very bored highly funded domestic association to start looking into the individuals whom gather and promote this .. from an informational perspective I don't think they can do much .. but since these files are being provided here on the forum it would definately become a target for litigation.

Hell I did a search on RM to see about one of the other games in the forums and sure enuff this link popped up with all the titles in forums for all the games on the forums ..

Not too discreet .. hopefully though this forum is not based in the United States .. and more so in a more liberal environment where extradition, justice etc .. is not so easily obtained.

I think discretion would now have to come in order ... to ensure that nothing of a litigation nature could be attempted .. not sure how to do that one ...

JCE doesn't care about the official US server so I doubt they would have any interest in sueing anyone for hosting a private server, let alone discuss them on a forum. At most they will contact the hosting company with a threat, they will either kick the forum off their server or forward the warning and demand that the content will be removed.

If ragezone is running it's own server, they'll just have to remove the content.

I strongly doubt JCE has any interest in going to court with the issue of illegal servers.

Plus, the biggest key is that this is unprofitable.

We are not making money off their hard work, but instead providing gaming fans with service that they have not recieved from JCE.

profit doesn't matter... it's whether or not their service (the server) is in use and they are recieving payment... an emulated server that requires payment is what you are thinking of.

Yes fogcutter there is a copyright notice. It is in there eula when you install there game. they do not have to show it everytime you open up the game. as long as you clicked yes i agree box when you installed you are permitted to use the game within the right they specified or else your illegally using there software. So yea there is a copyright and yes they have the right to come after us because atm we are the only american private servers. Even though we are not making a profit we are bringing in more people than the internation redmoon servers.

if anything i suggest when you get the new server files keep it hush hush. there are people hunting this sorta stuff down. now the chances of us getting caught is slim, theres always that .00001% that someone could post ip/forums/websites about this stuff in diff forums or chatroom and could screw this up

now i couldnt edit my post above but have any of you even realised that this game is about 5 years old. that hasnt occured to me until now. you can consider this game abandonware, JCE wouldnt spend money on a game like this, espiacally a game this old.

yes, they would. it's not abondonware until they no longer support it or recieve payment for it. basically, until the server shuts down and patches are no longer released.
