No he can't. COFusion is a name. That has to be registered or trademarked. Since it is neither, anyone can call their server, project, community, etc it if they want to. Copyrights are for work created to prevent improper/illegal distribution. And to add, COFusion do not own any copyrights on their work. Some will say "posting on the internet is an instant copyright" but that will not hold up in court. No one can be sued over this.
